[20] 21 Presently before the Court is the Parties’ Joint Status Report (“JSR,” ECF No. 29). 22 At the Parties’ request, the Court previously stayed this case for 90 days to allow the Parties 23 to pursue a master settlement resolving this and other cases spun out of the multi-district 24 litigation that spawned this case. ECF No. 25. At the expiration of the stay, the Parties 25 requested an extension so they could finalize a Master Settlement Agreement 26 memorializing the agreement in principle that they had reached. ECF No. 27 at 1–2. To 27 that end, the Court continued the stay for 90 additional days and directed the Parties to file 28 a joint status report at the conclusion of the stay to apprise the Court of any developments. 1 ECF No. 28 at 1–2. 2 Ninety days have passed, and the Parties indicate that they require additional time 3 “given the complex nature of this large settlement,” which involves over 300 cases. JSR 4 at 2. The Parties state that a “Master Settlement Agreement was finalized and executed on 5 August 9, 2024,” and the Agreement gives plaintiffs until November 7, 2024 to opt in or 6 out. Id. At that point, the Parties will evaluate plaintiff participation to determine the Final 7 Participation Threshold by November 25, 2024. Id. 8 A district court “may, with propriety, find it is efficient for its own docket and the 9 fairest course for the parties to enter a stay of an action before it, pending resolution of 10 independent proceedings which bear upon the case.” Leyva v. Certified Grocers of Cal., 11 Ltd., 593 F.2d 857, 863 (9th Cir. 1979). District courts have “broad discretion to stay 12 proceedings.” Clinton v. Jones, 520 U.S. 681, 706 (1997). Granting a stay “is appropriate 13 when it serves the interests of judicial economy and efficiency.” Rivers v. Walt Disney 14 Co., 980 F. Supp. 1358, 1360 (C.D. Cal. 1997). 15 The Ninth Circuit described the factors that a district court must consider when 16 determining whether to grant a stay in CMAX, Inc. v. Hall: 17 Where it is proposed that a pending proceeding be stayed, 18 the competing interests which will be affected by the granting or 19 refusal to grant a stay must be weighed. Among these competing 20 interests are the possible damage which may result from the 21 granting of a stay, the hardship or inequity which a party may 22 suffer in being required to go forward, and the orderly course of 23 justice measured in terms of the simplifying or complicating of 24 issues, proof, and questions of law which could be expected to 25 result from a stay.
[26] 300 F.2d 265 , 268 (9th Cir. 1962). 27 The CMAX factors weigh in favor of continuing the stay in this case. As both Parties 28 seek to stay this proceeding, the possible damage that could result from a stay is minimal. 1 || Requiring the Parties to incur further litigation costs in a case that is likely to settle imposes 2 ||unnecessary hardship. Finally, enabling the Parties to finalize their settlement will obviate 3 || the need for the Parties to litigate further, thus simplifying issues, proof, and questions of 4 ||law. Given that the Parties continue to make progress toward a settlement, the Court is 5 || persuaded that an extension to its prior stay is appropriate. 6 The Court thus STAYS this case for ninety (90) days from the date of this Order. If 7 ||the Parties do not file for dismissal within this period, the Parties SHALL FILE a joint 8 || status report at or before the expiration of the Court’s stay to apprise the Court of the status 9 || of the settlement and of this action. 10 IT IS SO ORDERED. 11 |}Dated: September 19, 2024 (een 12 on.
