PER CURIAM. This appeal from a judgment dismissing a complaint brought to enjoin alleged violations of the minimum wage and overtime provisions of the Fair Labor Standards Act of 1938, as amended, 29 U.S.C.A. § 201 et seq., is ruled by the decision of this court in Goldberg v. Nolla, Galib & Cia. (Goldberg v. Five Boro Construction Corp.), 291 F.2d 371 (C.A. 1, 1961), cert. denied, 82 S.Ct. 179 (U.S.Nov. 6, 1961). Judgment will be entered vacating the judgment of the District Court and remanding the case to that Court for further consistent proceedings.
