Parker v. Dendy

Griefin Smith, C. J. This appeal was submitted October 27. The decree was reversed November 3. The Chief Justice at that time wrote a dissenting opinion, concurred in by Mr. Justice McHaney and Mr. Justice Holt. On petition for rehearing four members of the court think the former determination was erroneous. Mr. Justice Frank G-. Smith, Mr. Justice Humphreys, and Mr. Justice Mehaeey adhere to the opinion of November 3, which they are handing down as expressive of their views.
