Upon consideration of appellee's motion for rehearing, we have withdrawn the original opinion and substituted the following as the opinion of the court: In the original opinion former Chief Justice HUDSPETH, who has since retired from the bench, dissented therein from the views of the majority. We deem it proper to note this fact.
