Judgment of the Appellate Division reversed and judgment of nonsuit affirmed, with costs in this court and in the Appellate Division on the ground that it does not appear that the stairway in question was not a proper stairway under all the circumstances of the case. No opinion. Concur: POUND, Ch. J., CRANE, LEHMAN and CROUCH, JJ. KELLOGG and O'BRIEN, JJ., dissent and vote to affirm. Not sitting: HUBBS, J.
