Order reversed on the law, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, upon authority of Missir v. American Oriental Ice Mfg. Co. (201 App. Div. 756), decided herewith. Black-mar, P. J., Rich, Kelly, Jaycox and Young, JJ., concur.
