Interlocutory judgment affirmed, with costs. All concur, except Hill, J., who dissents and votes for reversal on the law and for dismissal of the complaint on the ground that the finding of the jury establishes the defendant had an equitable lien on plaintiff’s interest in the real estate sought to be partitioned.
