In the Matter of Stanley Simmons, against Prison Board of Clinton Prison
Motion for leave to appeal, etc., denied upon the authority of Matter of Siraguso v. Moore (273 N. Y. 59). As we construe the opinion of the Appellate Division in People ex rel. Simmons v. Jackson (1 A D 2d 728), that court merely decided the merits of the application then before it.
