Russell, J. The incriminating circumstances raise a-grave suspicion of the defendant’s guilt, but are consistent with his innocence. Eor this reason the conviction of the defendant was unauthorized, and a new trial should have been granted. Judgment reversed. Poivell, J., dissents.
