Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered September 13, 1979, convicting him of three counts of perjury in the first degree, upon a jury verdict, and imposing sentence. Judgment affirmed. No opinion. This case is remitted to the Supreme Court, Kings County, for further proceedings pursuant to CPL 460.50 (subd 5). Titone, J. P., Mangano and Weinstein, JJ., concur.
