PROVOSTY, J. The question presented in this case is the same precisely as in State v. Bennie Green (No. 24363) ante, p. 376, 86 South. 919, this day decided. For the reasons there assigned, it is ordered, adjudged, and decreed that the indictment, verdict, and sentence herein be and are hereby annulled, and that the accused he discharged without day.
