PER CURIAM.
On the authority of Evans v. Parker, 440 So.2d 640 (Fla. 1st DCA 1983), and Margerum v. Ross Builders, Inc., 427 So.2d 261 (Fla. 5th DCA 1983), we reverse the dismissal of appellant’s action against appellee. See also Fla.R.Civ.P. 1.110(d).
