ON REMAND FROM ALABAMA SUPREME COURT
McMillan, judge.
Pursuant to Ex parte Robinson, 565 So.2d 664 (Ala.1990), the appellant was properly granted a new trial by the trial court. Therefore, the trial court is affirmed.
AFFIRMED.
