YATES, Judge.
The facts presented are essentially the same as those presented in Benbow v. Ben-bow, 601 So.2d 1012 (Ala.Civ.App.1992). The judgment in this case is affirmed on the authority of Benbow and Stack v. Stack, 646 So.2d 51 (Ala.Civ.App.1994).
AFFIRMED.
