MADDOX, Justice. The legal issue presented in this case is the same as that presented in Sheridan v. Board of Water & Sewer Comm’rs of the City of Prichard, 764 So.2d 526 (Ala.1999). The judgment is affirmed. AFFIRMED. HOOPER, C.J., and COOK, LYONS, and JOHNSTONE, JJ., concur.
