(dissenting): After the original opinion in this case was handed down, the case of Yeager v. Yeager, 155 Kan. 734, 129 P. 2d 249, was decided. For the reasons set forth in my dissenting opinion in the Yeager case I am unable to concur with the majority opinion in this case.
