Troutman v. Louisville & Nashville Railroad

Whitfield, O. J., delivered the opinion of the court. There was sufficient evidence in this case, manifestly, as to .the question of fact whether the deceased was killed by the running of the oars, to require the submission of that fact to the jury. The peremptory instruction was manifestly erroneous. Reversed and remanded.
