PER CURIAM: For the reasons set forth in the concurring/dissenting opinion, the findings of guilty as to Charge I and the single specification thereunder are set aside. Charge I and the specification thereunder are dismissed. The findings as to Charge II are affirmed. This action necessitates reassessment of the sentence. Upon reassessment, the sentence as adjudged and approved on review below is affirmed.
