Mr. Justice Hebel
specially concurs with the conclusion of this court that the judgment of the superior court of Cook county be reversed, but does not agree with the direction that the cause be submitted to a jury for the purpose only of determining damages to be awarded to Ida B. Tennes, the plaintiff, against Joe Tennes, the defendant. (John Deere Plow Co. of Moline v. Carmer, 350 Ill. 104.)
